Using Bickr means you agree to these terms. If you do not agree with them, please do not use the app.
The service
Bickr helps you and your group decide where to go, what to watch, what to cook and what to name the baby.
Information about venues and titles comes from third parties, and it may be incomplete, wrong or out of date. Check the details that matter to you, such as opening hours, prices and whether a place is still trading, with the venue itself before you rely on them.
Some screens link out to sites we do not run, including one paid link that is labelled as an ad. What is on those sites, and what they do with your visit, is between you and whoever runs them.
Who can use Bickr
You must be at least 13 years old to use Bickr. If we find out that an account belongs to someone younger, we delete it and what is in it.
The drink category deals licensed venues. Nothing in the app is an invitation for anyone under 18 to visit one, and the venue's own rules and the law about who it may serve are not ours to change.
Bickr uses Google Maps features and content. By using the app you also agree to be bound by Google’s Terms of Service and the Google Maps/Google Earth Additional Terms of Service.
TMDB
This product uses the TMDB API but is not endorsed or certified by TMDB.
Acceptable use
When you use Bickr, you agree not to:
- use it for anything unlawful, or to break anyone else’s rights;
- scrape, copy or otherwise extract its content in bulk, by any means;
- interfere with the service or with anyone else’s use of it, including by overloading it, disrupting it, or trying to reach parts of it you have not been given access to.
What your group sees
A group session shows everyone in the room your display name, and a saved group keeps the display names of the people who were in it. What you individually swiped is never shown to anyone.
The names you type, both your own and the name a group gives a night, are visible to everybody in that group. They must not identify or target anyone, and they must not be abusive. We can remove any of them, and every group has controls of its own for hiding a name or a night and for removing a member.
Bickr+
Bickr+ is an optional paid subscription. Everything needed to decide something is free and stays free: Bickr+ buys extras, and the app says which ones where they are offered.
- Price and currency. A$4.99 per month, or A$29.99 per year, in Australian dollars and including GST. The price shown to you at checkout before you pay is the price charged.
- Billing period and renewal. Whichever period you pick, the subscription renews automatically at the end of it, at the price then current, until you cancel. We will tell you before a price change takes effect for you.
- Payment. Payments are handled by Stripe. We never see or hold your card details.
- How to cancel. From your account, at any time, which opens Stripe's own billing portal. Cancelling stops the next renewal.
- What happens then. You keep Bickr+ until the end of the period you have already paid for, and the extras stop at that point. Nothing you kept while subscribed is taken away.
- Refunds. We do not refund the unused part of a period you chose to cancel. That is separate from your rights under the Australian Consumer Law, which we cannot exclude: if Bickr+ is faulty or is not what we said it was, you may be entitled to a refund, and asking us at hello@bickr.au is the way to start.
Content you send us
If you send us a photo or other content, for example a photo of your venue, or later a photo you submit in the app, you confirm that you have the right to share it with us.
You give Bickr a non-exclusive licence to show it in the app and in previews of the app, such as a shared link. We can decline or remove anything sent to us. If you want something you sent taken down, ask us at hello@bickr.au.
Intellectual property
The Bickr name, logo and app are ours, and these terms give you no right to use them. Venue, map and title content belongs to the providers it comes from and stays theirs.
Disclaimers and liability
Bickr is provided as is and as available. To the extent permitted by law, we do not promise that it will be uninterrupted or free of errors, that the information in it is accurate, or that a suggestion will suit you, and we are not liable for any loss that comes from using the app or relying on what it shows.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited rather than excluded, it is limited to supplying the service again, or paying the cost of having it supplied again.
Termination
You can stop using Bickr whenever you like. If you have an account you can delete it yourself, from your profile settings or at bickr.au/account/delete, and emailing hello@bickr.au works too. We may suspend or end your access if you break these terms, or if we stop offering the service. If we end a paid subscription for a reason that is not your breach, we refund the unused part of the period.
Changes to these terms
We may update these terms. The current version is always on this page, with the version and the date it took effect. If a change matters, we will say so in the app to anyone signed in and ask you to read it again. If you keep using Bickr after a change, you accept the updated terms.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of that state have jurisdiction over any dispute about them.
